RE: The tariff classifications of a headlamp housing from China

Dear Mr. Stark,

In your letter dated November 11, 2013, you requested a tariff classification ruling.

The items being considered are Headlamp Housings (Left-Part # 945 231-15; Right-Part # 945 231-16). The Headlamp Housings which you describe in your ruling request as “Lens Covers” are actually housing that fit around the front of an automotive headlamp unit assembly. You state that the Headlamp Housings are constructed of a polycarbonate plastic material, weigh approximately 61 grams and measure approximately 116 millimeters (mm) wide, 100 mm high and 80 mm deep.

The applicable classification subheading for the “Headlamp Housing” (Left-Part # 945 231-15 and Right-Part # 945 231-16) is 8512.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Electrical lighting or signaling equipment … , of a kind used for … motor vehicles; parts thereof: Parts: Of lighting equipment: Other.” The general rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
